1. Acceptance of Terms

By accessing or using the RealComply platform at real-comply.com (the "Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of a brokerage or organization, you represent that you have the authority to bind that entity to these terms.

2. Description of Service

RealComply provides AI-powered compliance verification for California real estate transaction files. The Service scans uploaded PDF documents for missing signatures, dates, addresses, and other compliance items as required by California DRE Regulation 2725. The Service generates Evidence of Supervision Reports for each file scanned.

3. Subscription Plans

The Service is offered through monthly and annual subscription plans. Plan details, pricing, and file limits are described on our Pricing page. We reserve the right to modify pricing with 30 days' notice to existing subscribers.

Free trial accounts are limited to 3 file scans. After the trial, a paid subscription is required to continue using the Service.

4. User Responsibilities

You agree to:

  • Provide accurate account information
  • Maintain the confidentiality of your account credentials
  • Use the Service only for lawful purposes related to real estate compliance
  • Not upload files containing malicious code or content unrelated to real estate transactions
  • Not attempt to reverse-engineer, decompile, or otherwise access the underlying technology

5. Limitation of Liability

RealComply is a compliance assistance tool, not a substitute for professional legal advice. While we strive for 99.9% accuracy, no automated system is infallible. The Service is designed to assist brokers in meeting their supervisory obligations under DRE Regulation 2725, but does not guarantee compliance. Brokers remain responsible for their own compliance obligations.

To the maximum extent permitted by law, RealComply shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

6. Refund Policy

We offer a 14-day money-back guarantee on all paid plans. If you are not satisfied with the Service, contact us within 14 days of your initial purchase for a full refund. Refunds are not available after the 14-day period.

7. Intellectual Property

The Service, including its design, features, and underlying technology, is the property of RealComply. You retain ownership of all transaction files you upload. Compliance reports generated by the Service are licensed to you for your business use.

8. Termination

Either party may terminate the subscription at any time. Upon termination, your access to the Service will end at the conclusion of your current billing period. We may also suspend or terminate your account if you violate these Terms.

9. Governing Law

These Terms are governed by the laws of the State of California. Any disputes arising from these Terms or your use of the Service shall be resolved in the courts of California.

10. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by email or by posting a notice on the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
